Description:
This session will provide a critical analysis of the U.S. Fair Housing Act’s requirement to Affirmatively Further Fair Housing (AFFH). Until recent rollbacks took effect under the prior federal administration, grantees receiving certain pools of funds from the Department of Housing and Urban Development (HUD) were subject to an AFFH mandate that involved performing an Analysis of Impediments to Fair Housing (AI) for their respective jurisdictions. The current administration is currently reviewing AFFH practices and preparing to issue new guidelines. To inform that process, presenters in this session will review strengths, limitations, and implications of the prior AI tool, using Buffalo and Erie County, New York, as a case study. Topics covered in the session include:
• The regional nature of housing systems and the geographies of fair housing issues
• Geographical and political barriers to addressing fair housing and implementing fair housing strategies
• Analytical strategies (and discretion therein) that lead to confusion and ambiguity in the geographies of fair housing
• Legal mechanisms to meaningfully incentivize state and local innovation in fair housing planning.
