Abstract
Communities receiving US Department of Housing and Urban Development (HUD) grants are required to “affirmatively further fair housing,” which is achieved through the completion of an analysis of impediments to fair housing choice. A critical component of the analysis if impediments (AI) includes the development of action plans to eliminate identified impediments. In Erie County, NY multiple HUD-grantees have undertaken, individually and/or collectively, analyses of impediments that identify persistent public policy and regulatory impediments to fair housing. This paper seeks to achieve two important objectives. First, it reviews past and current AIs to identify repetitively identified local regulatory impediments to fair housing and whether they have been addressed in subsequent regulatory changes. Second, Second, it seeks to identify the impediments to overcoming local regulatory impediments to fair housing.
